The officer may arrest the driver when the officer concludes, based upon the totality of the evidence he has observed, that there is probable cause to believe that the driver has an unlawful blood alcohol content, or was driving while impaired. This is a very subjective decision, and it is very difficult to argue that an officer made an illegal arrest, even if you disagree with the officer's conclusions.

California's highest court on Wednesday refused to order Gov. Arnold Schwarzenegger and the state's attorney general to appeal a federal ruling that overturned the state's gay marriage ban. The court did not explain why it rejected the emergency petition filed by the Pacific Justice Institute, which had argued that the governor and the state AG were required to uphold all laws, including initiatives passed by voters.
A Delaware Chancery Court judge has ruled in favor of eBay in a shareholder suit against Craigslist and majority shareholders Jim Buckmaster and Craig Newmark. The ruling rescinds a measure adopted by Craigslist's board that would have blocked a potential hostile takeover by San Jose, Calif.-based eBay. But in a split ruling, the decision also left in place Craigslist's staggered board provisions, which were passed in an effort to remove eBay's board seat.
