  Do Defendants Have The Same Rights When Facing Misdemeanor And Felony Charges?
 

A defendant charged with a misdemeanor has fewer legal rights than a defendant charged with a felony. If the defendant will not face imprisonment as a result of conviction, he has no right to an attorney. There is no right to indictment by grand jury, or to a "preliminary examination" to review the basis of the charges filed. In some states, misdemeanor charges are tried before six person juries, whereas felonies are ordinarily tried before twelve person juries. Most other rights are the same, for both felonies and misdemeanors.

Associate salaries stagnated last year at large law firms, according to data released Thursday by the National Association for Law Placement. NALP said that while $160,000 remained the prevailing starting salary at large firms in major cities such as New York and Los Angeles, a higher percentage of associates last year started with salaries of between $130,000 and $145,000. However, compared to what many in the legal profession feared might happen, the news was relatively positive, said NALP's executive director.

A federal judge has ruled that policy prohibiting openly homosexual members from serving in the U.S. military is unconstitutional. Central District of California Judge Virginia Phillips issued her ruling late Thursday in Log Cabin Republicans v. United States of America. Phillips found that the 1993 statute known as 'Don't Ask, Don't Tell' impeded both the Fifth and First Amendment rights of homosexuals, and granted a permanent injunction.

A federal appeals court on Thursday morning granted a temporary stay of a judge's controversial ruling blocking funding for human embryonic stem cell research. The Justice Department asked for the stay Wednesday in the U.S. Court of Appeals for the D.C. Circuit, noting in court papers that a stay is necessary "to avoid immediate loss of ongoing medical research aimed at curing the most devastating illnesses afflicting Americans."
